Christopher Kitty Grey, a transgender inmate, wants to be in a women's prison, but Colorado state policy forbids it because he has male genitalia.

Grey is serving 16 years to life in Limon Prison, southwest of Denver, for molesting an 8-year-old girl for five years, the Denver Post reported.

He believes Colorado has a constitutional obligation to perform a sex-change operation on him so he can go to a women's prison. He's filed a lawsuit against the state, demanding to be treated by a psychologist who is a gender specialist.

Grey has appealed to the Colorado Supreme Court. If Grey wins, the expert would undoubtedly conclude Grey must have the operation for his mental and emotional well-being, the newspaper said.

Currently, no state pays for or performs sex-change operations for inmates, although some inmates have tried to get them to.

Grey has been in segregation since the day he arrived at Limon. In other prisons, Grey twice became the sexual partner of tougher inmates who protected him, saying it was only for survival's sake.

"I shouldn't have to prostitute myself to remain safe," Grey said.
